Lower Thames Valley Conservation Authority

All data for this application must be submitted to the Upper Thames River Conservation Authority (“UTRCA”). The UTRCA, in its capacity as the Upper Thames River Source Protection Authority, is the lead agency of the Thames-Sydenham & Region Source Protection Region (“TSRSPR”). Terms not defined in this section, but defined elsewhere in the application, still apply.

1. Assessment report data submitted in support of this application are subject to the following:
a) The Municipality retains all right, title and interest in their data submitted
b) The Municipality grants the UTRSPR a perpetual, non-exclusive, royalty-free license to use, execute, publish, modify, copy, reproduce and prepare the data in any form
c) The Municipality represents and warrants that it has secured the necessary rights to any third party data submitted that it needs to make this grant of license
d) The Municipality should ensure that any submitted assessment report data follows the format and schema specified in the assessment report database template

2. The UTRCA is considered the authoritative source for the Assessment Report Database (“ARDB”) and Policy Database (“PDB”) for the TSRSPR.
a) The Municipality acknowledges that the UTRCA retains all right, title, and interest in the TSRSPR ARDB and TSRSPR PDB (collectively, the“TSRSPR Data”).
b) TSRSPR Data is considered draft until formal approval is received from the Ministry of Environment, Conservation and Parks (“Province”).
c) Derivative forms of information submitted with this application may form part of the TSRSPR Data.
d) TSRSPR Data approved by the Province, as updated from time to time, is available for download. TSRSPR Data in draft form may be requested from the UTRCA.

3. The Municipality and/or its Risk Management Office is considered the authoritative source of data concerning the enumeration of significant drinking water threats, and is considered the source for threats data.

4. The Municipality is responsible for notifying adjacent municipalities and/or source protection authorities if the proposed work, including any new or altered source protection zones, extends into adjacent jurisdictions.

Information collected on this application is done in respect of the Municipal Freedom of Information and Protection of Privacy Act (MFIPPA), and under the legal authority of the Clean Water Act, 2006, S.86 as amended.
